PHI
To the extent personal information that includes protected health information (PHI) is maintained on the Website, our access, exchange, use, and disclosure of such PHI is done so in accordance with applicable legal and contractual requirements and is described in our Joint Notice of Privacy Practice, which can be found here.

The use and disclosure of PHI is governed by the Business Associate Agreement and service agreements between The Foundation and your organization, and by applicable law.

- You may access PHI and confidential information through the Website
- You are responsible for protecting any information you access
- You will comply with your organization’s policies regarding data access and handling
- Unauthorized access, use, or disclosure of PHI may result in termination of access and may be subject to civil and criminal penalties under applicable law
- You will promptly notify The Foundation if you become aware of any security incident or potential breach involving the Website or the information accessed through them
Site Visitor Information Which May Be Collected and Stored. The Foundation may automatically collect certain usage information from your device when you visit the Website. This information may include information about:
- Your internet service provider (ISP).
- Your domain name.
- The date and time you accessed our Website.
- The pages you visit.
- The internet address from which you linked to our Website.
We may collect this data, from time to time for statistical purposes and to help make our Website more useful to visitors. We cannot identify you from this information.

However, third parties retained by The Foundation to provide such services are obligated by applicable agreements with The Foundation to maintain the confidentiality of this information as we describe and are not authorized to use this information for any purpose other than providing those contracted services.
We may disclose the personal information we collect through the Website, when we, in good faith, believe disclosure is appropriate to comply with law (or a court order or subpoena); to prevent or investigate a possible crime, such as fraud or identity theft; to enforce the Terms of Use or other agreements with you; or to protect the rights, property or safety of The Foundation, our users, or others.
The Foundation may use your name and postal address to send you information advising you of our announcements from our group, such as new physicians, new office locations or other information we believe may be of interest to you or provide you educational benefit.
The Foundation may use personally identifiable information for internal purposes, such as tracking demographic data to make this Website more useful to our visitors. The Foundation will disclose personally identifiable information if required by law to do so.
Except as identified above, The Foundation will not make your name and postal address available to any other organization.
What About Cookies, Other Information, and Websites?
The Website uses cookies and similar technologies to enable core functionality, analyze site usage, and improve your experience. While we do our best to protect your personal information, we cannot guarantee the security of any information that you transmit to us and you are solely responsible for maintaining the secrecy of any passwords or other account information.
Mobile Information and SMS Communications
As you use the Website, you may have the option of receiving Short Message Service (SMS), or texts (electronic communications) (collectively “Messages”). The Foundation may communicate with patients and customers via such Messages for a variety of reasons such as:
- Appointment confirmations
- Appointment reminders
- Service notifications
Data Rates from your wireless carrier may apply to your receipt of such messages. Any costs incurred as a result are your responsibility. Messages may come from us directly and/or from third parties on our behalf.
By providing your mobile number, you agree to receive live, pre-recorded and artificial voice and electronic communications and by providing your e-mail address you agree to receive e-mail and agree that the that the device(s) and account(s) that will receive the electronic communications are appropriately secured. Messaging frequency varies.
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with our services. We may share your personal information, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to Website providers, phone companies, and any other vendors who assist us in the delivery of text messages.
You may cancel SMS communications at any time by texting STOP to 1-866-426-5858. After sending STOP, you will receive confirmation that you have been unsubscribed. Responding to Requests. We endeavor to substantively respond to a verifiable request within forty-five (45) days of its receipt. If reasonably necessary, depending on the type and complexity of the request, we may extend the response time for another forty-five (45) days, so as long as we notify you within the first forty-five (45) day period.
- If we decline to take action regarding your request, we will endeavor to notify you within forty-five (45) days of our receipt of the request. When we do so we will provide a justification for not taking action and provide information on whether there is an appeal process and how to initiate such process.
- You can request information free of charge twice per year. Depending on your state of residence, any subsequent requests within a twelve (12) month period may result in a reasonable fee not to exceed the actual cost of providing a copy, printout, or photograph of the record in a format other than a standard page.
COPPA Compliance
The Platform is not directed at children under the age of 13. We comply with the Children’s Online Privacy Protection Act (“COPPA”) and do not knowingly permit registration or submission of personally identifiable information by anyone under 13 years of age without verification of parental consent. If you believe information of a child under 13 has been submitted, please advise us in writing and we will delete it. If we learn that a child has provided personal information, except as required and authorized by law, we will delete that information from our system.
